Trump should be disqualified from being President after he says he would try Americans in Guantanamo

Recently, Donald Trump <a href="http://www.miamiherald.com/news/politics-government/election/donald-trump/article95144337.html">indicated</a> he wants to try "Islamic terrorists", even if they are American citizens, at Guantanamo Bay. The Miami Herald interviewer asked Trump, "Would you try to get the military commissions, the trial court there, to try U.S. citizens?". Trump responded with "Well, I know that they want to try them in our regular court systems, and I don’t like that at all. I don’t like that at all. I would say they could be tried there, that would be fine."

Wow... What? Really, he does say it (see link above). Would this not be a violation of the President's duties and oath of office? Trying American citizens in Guantanamo can't be legal, right?

The President takes the following <a href="https://www.law.cornell.edu/constitution/articleii">oath or affirmation</a>: "I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

- guarantees a fair process in all hearings
- guarantees equal treatment under the law
- provides for a pretrial hearing by a grand jury in felony cases
- outlaws a second trial for the same crime (double jeopardy)
- protects suspects from having to answer questions which could be used against them
- guarantees fair proceedings when people are threatened by a loss of life, liberty, or property by the government
- ensures compensation for people whose property is taken by the government
- protects people from unreasonable police searches and seizures
- sets requirements for search warrants
- requires a speedy and public trial by an impartial jury
- requires someone accused of a crime to be informed of the charges and evidence
- requires that the accused be present when witnesses testify against him/her
- provides for the accused to have a lawyer and call witnesses in defense
- requires the courts to set reasonable and consistent bail
- requires the courts to suit the sentence to the crime

Do you think you could get these rights in Guantanamo Bay? Now you tell me, does he plan to violate his oath and the Constitution? If so, doesn't that mean he is disqualified to be President? You tell me...
