A highly simplistic argument which again ignores what I said in the actual post. One or two people doing it is better than nearly everyone doing it. It is akin to saying that drink driving should be legal because no matter what laws you make some people will still do it - therefore we should not only legalise it but hand out free alcohol to everyone at traffic lights who is driving a car. That doesn't really make any sense.
